DivvyUpp is a non-custodial spending layer and budget tracking application provided by DivvyUpp Inc. ("DivvyUpp," "we," "us," or "our"). The Service helps you analyze spending, set budgets, track savings goals, and receive notifications about your financial activity. DivvyUpp is not a bank, does not hold your funds, and does not provide financial advice. All bank account connections are read-only.
2. Eligibility & Account
You must be at least 18 years old and a United States resident to use the Service. By creating an account, you agree to:
- Provide accurate and complete information during registration.
- Keep your login credentials secure and confidential.
- Notify us immediately of any unauthorized use of your account.
- Accept responsibility for all activity under your account.
3. User Responsibilities
- Accurate Information — You are responsible for the accuracy of income, expense, and savings data you enter into the app.
- Credential Security — Keep your account password and any connected banking credentials secure. DivvyUpp is not liable for unauthorized access resulting from compromised credentials.
- Lawful Use — Use the Service only for personal, lawful purposes. Do not attempt to reverse-engineer, exploit, or disrupt the Service.
- Savings Attestation — Savings confirmations in DivvyUpp are user-attested. We do not move or hold your funds.
4. Third-Party Integrations
DivvyUpp integrates with the following third-party services. You connect your own accounts and are subject to each provider's terms:
- Plaid — Provides read-only access to your bank account balances and transaction history. DivvyUpp never accesses your bank login credentials directly.
5. Limitation of Liability
- DivvyUpp is a budgeting and spending awareness tool. We are not a bank, financial advisor, or fiduciary. Nothing in the Service constitutes financial advice.
- We provide the Service "as is" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
- DivvyUpp is not responsible for losses arising from bank outages, third-party service interruptions, incorrect transaction data from your bank, or your reliance on budget calculations.
- To the maximum extent permitted by law, DivvyUpp's total liability to you for any claims arising from the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.
6. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you agree to the terms of our Privacy Policy.
7. Termination & Account Deletion
- You may delete your account at any time through the in-app profile settings or by contacting support@divvyupp.com.
- Upon deletion, your personal data will be removed within 30 days, except where retention is required by law.
- We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive activity.
8. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated terms in the app and updating the effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
